DESCRIPTION OF THE BUILDING TO BE SOLD
AND ITS LEGAL CONDITION

 

DESCRIPTION OF THE BUILDING :  The building to be sold consists in a land with an area of 438 sqm and a building made of reinforced concrete, with four floors: basement + ground floor + first floor + second floor, with a total useful area of 1077 sqm, with concrete walls for exterior perimeter closures and inner separation.

The building status is: to be completed.

The building has access to the public networks of electricity for illumination and power, water supply, sewage system, telephone and gas supply. 

It is located on an important road in Pajura Neighbourhood, closed to FLORA Hotel,  PUZDREA  commercial complex -  location in AREA I;  closed to public transportation: buses, trolleys; closed to LUKOIL tank station, to a general school, a high school, an industrial railway.

The building could have various destinations: offices, mini-hotel, restaurant, commercial centre (supermarket), block of flats. 

According to the EXPERTISE REPORT made in February - March 2007 by the evaluator eng. Hărduț Bucur-Florea, expert of the LOCAL OFFICE OF TECHNICAL AND REAL ESTATE EXPERTISE OF BUCHAREST COURT, the updated value of the real estate located in Bucharest, str. Jiului nr.153, sector 1, amounts on March 19, 2007 to EUR 523.570, the equivalent of 1.752.755,29 RON.

 

LEGAL CONDITION: S.C. FLORIAN HAUS PRODCOM S.R.L. - BANKRUPT has a litigious property right on the real estate located in Bucharest, str. Jiului nr.153, sector 1, obtained as follows:

According to the sale-purchase agreement no. 999/28.05.1998 authenticated by notary public, S.C. FLORIAN HAUS PRODCOM S.R.L. purchases the above-mentioned real estate.

According to the mortgage agreement authenticated under no. 1050/09.07.1998, ION ȚIRIAC COMMERCIAL BANK - Bucharest Branch obtains a real estate guarantee on this real estate for having granted several successive credits.

On November 3, 2000, the former administrator of S.C. FLORIAN HAUS PRODCOM S.R.L. fraudulently strikes down the mortgage through false documents and sells the real estate.

In the commercial sentence no. 295/16.02.2005, the syndic judge cancels all the successive sale-purchase agreements involving the real estate and the real estate becomes again the property of S.C. FLORIAN HAUS PRODCOM S.R.L.

A distraint is currently levied on the real estate, which is under the legal liquidator's supervision.

In the sentence of January 17, 2007 passed in the bankruptcy record no. 231/3/2000, the syndic judge decided the evaluation of the real estate, the summoning of the creditors' meeting of S.C. FLORIAN HAUS PRODCOM S.R.L. to establish the capitalization method, as well as the sale of this asset according to the Decision of the Creditor's Meeting.

In the decision of April 18, 2007, the General Creditors' Meeting decides to capitalize the real estate through direct sale, according to the procedure laid down by art. 118 of Law 85/2006.
